The soldier who gave the order is subject to Court Martial under the UCMJ as well as those who signed the agreement. I think the U.S. Department of Defense needs to be brought into the picture as they have the authority to interview every soldier who signed the non-disclosure agreement to not tell anyone of the incident and force every soldier to testify. This is getting worse every hour and it will only come to a head when there is a Court Martial filed against all soldiers who signed the non-disclosure agreement as they also aided the enemy by signing such an agreement. This also explains why some of the soldiers who signed the agreement aren't saying anything to the press or anyone else. Some soldiers have made statements. It remains to be seen if all will volunteer to make a statement or be ordered to by the U.S. Department of Defense or another agency of the U.S. government. Personally, I think those who signed the non-disclosure agreement did so because they all agreed to shoot to kill Bowe R. Bergdahl were they to find him. That's what is done in this type of situation while engaging an enemy in a dangerous combat situation. This was done in WWII, Korea, and Vietnam. A soldier who places the lives of those with whom he is serving in danger has to be removed from the area and oftentimes the only way to remove that soldier is to kill him and then show him as "killed in Action".
